This matter relates to the Vasind Town in Tahasil Shahapur of Thane District (Maharashtra State of India). Local Administration /Authorities have been ignoring the problems of road users in this triable populated locality of the State of Maharashtra. It is well known fact that Level Crossing (LC) Gate No. 62 was closed by railways long back without providing alternate access. Since then the general public is facing day-to-day problems due to non-accessibility from one side to the other of the Central Railway Line passing through the town.

Due to closure of LC No. 62 by railways, MDR-45, ODR-181 which connected to the important roads like NH-3 and NH-222 were rendered useless. The population of Vasind town and other surrounding villages counts for around 1,00,000 and they are not only accessible to NH-3 & NH-222 but they are also not able to avail local amenities like, markets, hospitals, schools, banks, Post Offices, Cooking Gas, Petrol Pump, Panchayat, Tahasil and District Headquarters Offices. In order to address the issue of water logging of the existing RUB, Central Railways has recently provided sump & pump arrangement to bail out water from RUB. The people are thankful to the railways for this kind of act but this arrangement is not purposeful when large amount of water, say almost mounting water up to the level of top of the RUB in the rainy season. In these circumstances the people remain helpless even in the medical and fire emergencies. This matter has been taken up by the National Human Rights Commission of India with Divisional Railway Manager (DRM), Central Railway, Mumbai and the District Collector of Thane District but it seems that the authorities are not paying much attention in the proportion of the public problems in this triable populated area.

In a report dated 12.08.2015 submitted by ADEN (Wks) KYN to the Hon. National Human Rights Commission of India it was mentioned that :

(1) ROB at the location of the L-xing is being processed by PWD at a cost of Rs. 32 Crores.

(2) Joint Inspection of the ROB has already been done by Railways & PWD authorities.

(3) Based on the joint inspection GAD was finalized.

It is understood that copies of GAD and Technical Note were sent to the Executive Engineer, Road Project Division, Konkan Bhavan, Navi Mumbai by the SE (BR), DC, Konkan Bhavan Navi Mumbai vide letter Outward No. BR-III/TNE-111/516 /2015 dated 31.03.2015 for further necessary action with the mention that "Considering complexity of the site, it would be desirable to invite lump-sum tenders based on contractor's alternative designs, with endorsing copies of the communication to the SE, PW Circle, Thane and the EE, TCD,Thane .

It is further understood that the EE, TCD, Thane had submitted GAD and Technical Note to the Senior Divisional Engineer, CST Rly. Station, Mumbai vide letter No. TCD/PB4/2915 dated 8.4.2015 for approval of the proposal. The similar request for approval of the proposal was made by the EE, TCD, Thane to the ADEN, Kalyan (Works), Kalyan Railway Station, Kalyan also in May, 2015.

It is further understood that the ADEN, Kalyan (Works), Kalyan Railway Station, Kalyan vide his letter No. ADEN/Wks/KYN/BB/ W/ 5074/VSD dated 1.6.2015 had desired to make certain changes in the GAD as discussed with Shri P.G. Gore in his office and requested to resubmit the modified GAD to Central Railway for approval at the earliest.

Hon. National Human Rights Commission of India has again directed the Secretary, PWD, the DRM, Central Railway, Mumbai and the District Magistrate, Thane to submit current status of the case in the proceedings as mentioned below:

"These proceedings shall be read in continuation of earlier proceedings of the Commission dated 06.07.2015 vide which reports were called for from the Divisional Railway Manager, Central Railway, Mumbai, and District Collector, Thane. Pursuant to the directions of the Commission, the ADEN (Wks) KYN, has submitted his report dated 12.08.2015, in which it is stated as under : "(i) Any new road for vehicular traffic across Railway tracks has to be proposed by the State Government. Since the ROB at the location of L-­xing is being proposed by PWD, hence, RUB is no more required in the long run. Inspite of this, to address the issue of water logging of the existing RUB, Railway on their own have in May 2015 provided a sump and pump arrangement to bail out water from the RUB. The system has been on the whole functioning satisfactorily since then. (ii) and (iii) to be dealt by local bodies. (iv) The construction of a new ROB at the location of the L­-xing is being processed by PWD at a cost of Rs.32 crores. Joint inspection of the ROB site has been done by Railways and PWD authorities. Based on the inspection, a GAD has already been finalized. The same is under approval of PWD authorities after which it will be submitted by PWD to Railways for approval. (v) To be dealt by Bhatsa Canal Division". The Commission has perused and considered the report. Let reports be called for from the Secretary, PWD and District Magistrate, Thane. Copies of the relevant papers be transmitted to them. Divisional Railway Manager, Central Railway, is directed to submit the current status report. Response within six weeks. Additional Information Called for (Dated 2/22/2016) Response from concerned authority is awaited".[1]
