I have a recollection from back in the 70's of the expression "A special defense of Aliter" being used in the context of a Special Defence of Incrimination. (I was reminded of this while watching the US TV show "The Thing about Pam" where the lawyer wanted to use such a defense but was disallowed by the Judge)
