Statutory Authority & Purpose

This Board was established in 1972 (Chapter 13, Acts of 1972) to review Maryland State Police decisions regarding handgun permits.

Any person whose application for a handgun permit, or renewal of a permit, has been rejected or limited, or whose permit has been revoked may ask the Board to review the decision of the Superintendent of the Maryland State Police. The Board can sustain, reverse, or modify the decision of the Superintendent based on a hearing conducted to establish the facts.

Meetings

The Handgun Permit Review Board meets the 1st and 3rd Tuesdays of each month at 7:00 p.m. at the Maryland State Police Barracks “P,” 6800 Aviation Blvd., Glen Burnie, MD 21061. The Board may also meet on the 5th Tuesday of a month.

The Board consists of five members appointed from the public by the Governor with the advice and consent of the Senate. The term of a member is 3 years. The terms of the members are staggered as required by the terms provided for members of the Board on October 1, 2003. At the end of a term, a member continues to serve until a successor is appointed and qualifies. A member who is appointed after a term has begun serves only for the rest of the term and until a successor is appointed and qualifies. A member of the Board is eligible for reappointment. (Article 27, §36E).

Compensation

A member of the Board is entitled to compensation in accordance with the State budget for each day that the member actually is engaged in the discharge of the member's official duties; and reimbursement for expenses under the Standard State Travel Regulations, as provided in the State budget. § 5-302. FY 2014 the Board Chairman is paid $147.00 per meeting; 3 board members are paid $124.00 per meeting; and one board member is paid $116.00 per meeting.
FY 2013: the Board Chairman was paid $142.00 per meeting; 3 board members were paid $120.00 per meeting; and one board member was paid $109.00 per meeting.

Maryland is one of four jurisdictions, includig NY, NJ and DC, that have yet to recognize the recent Heller and Peruta decisions. Georgia, California and Guam are the lastest to recognize the individual, inalienable right to self defense.

Supporters contend that fewer guns mean less crime. Critics assert that incarcerating criminals is the best, most efficient way to reduce crime and violence. Adding that "may issue" permitting schemes are unlawful, do nothing to reduce crime, are racist in implementation and favor those with politcal connections.
