Defendant or plaintiff??

[edit]

From the article: "He and his wife, Jayne, are named defendants in the Supreme Court decision Bray v. Alexandria." Since the Bray name is first, weren't they the plaintiffs? Anyone know more of this case? 199.181.153.178 (talk) 16:06, 24 February 2009 (UTC) OrangeSam, 2/24/09[reply]

It appears that Bray was the plaintiff. See Bray v. Alexandria Women's Health Clinic. Toddst1 (talk) 00:22, 25 February 2009 (UTC)[reply]

The Alexandria Womens' Clinic was the plaintiff and won in the lower courts. Bray petitioned for certiorari and won in the Supreme Court. It is the petitioner whose name appears first in Supreme Court citiations; more generally,in most court systems the party who came to the court in question seeking the court to take action (in this instance, reversing the decision of the lower court) whose name appears first.
