Replaceable non-free use File:Ted Prior headshot.png
Thanks for uploading File:Ted Prior headshot.png. I noticed that this file is being used under a claim of non-free use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of non-free use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:
- Go to the file description page and add the text
{{Di-replaceable non-free use disputed|<your reason>}}
below the original replaceable non-free use template, replacing<your reason>
with a short explanation of why the file is not replaceable. - On the file discussion page, write a full explanation of why you believe the file is not replaceable.
Alternatively, you can also choose to replace this non-free media item by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by creating new media yourself (for example, by taking your own photograph of the subject).
If you have uploaded other non-free media, consider checking that you have specified how these media fully satisfy our non-free content criteria. You can find a list of description pages you have edited by clicking on this link. Note that even if you follow steps 1 and 2 above, non-free media which could be replaced by freely licensed alternatives will be deleted 2 days after this notification, per the non-free content policy. - @Marchjuly I did: Well while Prior is alive, he is past his prime and semi-retired from show business. It is unlikely he will return as an action film leading man. - The default as never been to use a non-free image of some simply to show how they appeared in their prime unless their Wikipedia notability largely or entirely depends upon their physical appearance. If this wasn't the case, there would be no biographies of still living actors, athletes or pretty much anyone else that didn't have a non-free image being used in the main infobox. Moreover, there's really nothing at all "historical" about this picture other than the fact that it's from an earlier period of Prior's life so the license you chose isn't really applicable. If you disagree with this assessment, then you can contest the speedy deletion of the file by following the instructions given in the template I added to the file's page. An administrator will review both the template I added and any comments you add, and figure out what to do. -- Marchjuly (talk) 05:53, 20 July 2023 (UTC)
- @Marchjuly look I disagree with you. I was just trying new things that's all.
- You are right the photo doesn't present the physicality of Prior, but simply a headshot of what he looked like during his prime.
- You may have a point with some subjects, but as soon as they become artist who present themselves in front of a camera I think it's different because of the visual aesthetics that comes with it.
- I think it is quite confusing when you see someone who was well known during a time period and have a photo prior or after fame., especially for musicians, models, and actors.
- Never the less I found a photo of Prior on ebay which seems to be public domain. Let me know what you think.

- Regarding Lilly Yokoi the subject in your post below, there is a lot of context about who she is and what she did during her prime. That article is mostly a passion project by @S0091 for which I helped, maybe that user has some input.
- It's up to you while I see your point with Prior, as the physicality of an action star isn't present in the photo, it does have visual aesthetics of the late 1980s and early 1990s.
- Look at the end of the day it is the default, while I disagree with it, it is the default.
- So look at the end of the day if these photos have to go because we disagree so be it, it's mostly me trying something new.

- @Marchjuly, I did. It is not known if the subject has passed or is nearly 100 years old. Hence if a free alternative manifests itself, she will not look like what she did in her prime or will be let go in the public domain in the near future. Filmman3000 (talk) 05:43, 20 July 2023 (UTC)
- Wikipedia isn't going to assume the subject is dead per WP:BDP until she reaches 115 years of age. If it can be verified through reliable sources that she indeed is dead, then a non-free image does become a bit easier to use. However, even for deceased individuals, non-free use isn't automatic and any such use would still need to meet WP:FREER. A free equivalent image doesn't necessarily need to be a newly taken image; it can be an existing image in which the copyright holder agrees per WP:PERMISSION to release the file under a free license that can be used by Wikipedia, or it can be an existing image which was perhaps once protected by copyright but now is perhaps within the public domain for some reason. Lots of actors around the same age as Yokoi had publicity photos taken of them during the prime years of their careers. Many of these were protected by copyright but now are in the public domain because their copyright wasn't formally removed. Many others never were properly marked with a visible copyright notice which meant they weren't considered protected under US copyright law. The file you uploaded might even already be in the public domain, but this is hard to assess without knowing more about its provenance. The photo obviously didn't originate from circopedia.org, but if the provenance of the photo can be sorted out and it can be shown that it's within the public domain, then the file's licensing can be change and the file kept. One possible free image of Yokoi might be this one found on Ebay.There doesn't appear to be a visible copyright notice on that photo's front or back which means it could possibly be {{PD-US-no notice}} and OK to use for Wikipedia's purposes. Another possible one is this. These would probably be something to ask about at c:COM:VPC because that where the photo should be uploaded if it's within the public domain. People often sell old publicity photos on sites like Ebay and in many cases they upload images showing the front and the back. If you can find one that shows both the from and the back on one of these sites without a visible copyright notice on either side that hasn't had it's border cropped out (copyright notices often found in the borders of such photos), then that too might be already in the public domain. Even if it has a copyright notice, if it was published prior to January 1, 1964, there's a good chance it's copyright wasn't renewed at it would be OK to upload as {{PD-US-not renewed}}. -- Marchjuly (talk) 06:14, 20 July 2023 (UTC)
