The purpose of using this image is educational, using it to illustrate an encyclopedic biography of the subject of this photo. 4. The photographer taking this image is unknown. There is no one from whom to obtain copyright clearance. 5. The image has previously been published in a scholarly work: Randi Storch, Red Chicago: American Communism at Its Grassroots, 1928-35. (Urbana: University of Illinois Press, 2007); pg. 15. This indicates that a good-faith search for the photographer or that photographer's heirs has been performed. 6. Since the image dates from the 1930s, in all likelihood the photographer is by now dead and the photographer's children may well be dead. There may well be no one from whom to obtain copyright clearance even if the photographer's name were known. 7. Because the image has been published, any potential commercial value of the image's first use has already been deprecated. 8. The image is a low resolution rendition of the original — a 96 dpi scan of a halftone. 9. Use of this image is to be limited to illustration of a single article.
