The image on its face does not contain enough originality to be eligible for copyright. Furthermore, it incorporates elements that, even if they were copyrightable, are already be in the public domain in the United States. The typography and layout of the magazine title were established in issues published more than 95 years ago (see Cahiers d'Art 1926 no. 4.jpg for example), the copyright for which has therefore expired. The concept of a red heart on a blue background to create an illusion of vibration was already well known as the "fluttering hearts illusion".
