Summary
[edit]Upon further review, the reason the photo should be restored is the following which is based on Wikipedia's Exemption Doctrine Policy, as found in (http://en.wiki.x.io/wiki/Wikipedia:Non-free_content)
a) added transformative value by explaining the importance of the photo in the captioning which conforms to the fair use clause of American copyright law
b) Images with iconic status or historical importance, Pete Conrad was one of the figures involved in the American space race. Since it has been at least half a century since the end of the era, not to many people would be too familiar with his likeness. Moreover, wikipedia serves as a repository for the world's shared cultural heritage.
c) Pictures of deceased persons, in articles about that person, provided that ever obtaining a free close substitute is not reasonably likely. (dead for a decade)
d)Other promotional material, the whole point of advertising is to spread the message of the product, which I did by providing the attribution of the image (American Express).
Licensing
[edit]This image is a faithful digitisation of a unique historic image, and the copyright for it is most likely held by the person who created the image or the agency employing the person. It is believed that the use of this image may qualify as non-free use under the Copyright law of the United States. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. Please remember that the non-free content criteria require that non-free images on Wikipedia must not "[be] used in a manner that is likely to replace the original market role of the original copyrighted media." Use of historic images from press agencies must only be of a transformative nature, when the image itself is the subject of commentary rather than the event it depicts (which is the original market role, and is not allowed per policy). | |||
