- it is a low resolution copy of a book cover;
- the author of the book, Mary Louisa Molesworth, died over 100 years ago
- the book is out of print
- it does not limit the copyright owner's rights to sell the cover art in any way;
- copies could not be used to make illegal copies of the cover artwork;
- the image on the cover is significant because it was made by a famous artist, Lewis Hart.
